Marketing Criteria

I certify that the following statements are true about the application being submitted:

• There is no profanity in the description, title, or screenshots.
• There are no spelling errors in the description, title, or screenshots. Intentional misspellings are permitted if related to the marketing of the application.
• The screenshots are accurate and were taken of the same .ipk file that is being submitted.
• The primary and secondary categories are accurate representations.
• The version is accurate and is higher than previous versions published in the Palm App Catalog.
• The application and any and all materials being submitted by you for use in the Palm App Catalog, including but not limited to the description, title, screenshots, and content of the application, do not (i) use any proprietary information of another party without appropriate authorization, (ii) infringe or misappropriate the intellectual property rights (including, without limitation, patent, copyright, trademark or trade secret rights, or rights of publicity or privacy) of another party, or (iii) present the application or any such materials in a fraudulent or deceptive manner.
• The Paid App Category chosen, if applicable, is accurate and the most appropriate selection among the choices provided.
• The submitted Support details are accurate and will be kept updated for the duration that the application is distributed in the Palm App Catalog.
• The Copyright and Trademark Notice is accurate and complete.
• The usage of encryption is accurately noted and if applicable, the provided CCAT code is accurate.
• All provided web links for the app description are accurate and will be maintained while the application is distributed in the Palm App Catalog.

Content Criteria

I certify that the following statements are true for both the application being submitted as well as any advertising that may be visible on or through the application:

Section 1: Legal Requirements

• The application does not include any viruses or other malicious code.
• The application does not facilitate users transmitting viruses, worms, spam, Trojan horses, malware, or any other similarly destructive items.
• The application does not facilitate users engaging in fraudulent, deceptive, dangerous or illegal activities. These include but are not limited to the following: 1) child pornography, 2) gambling with real currency, including without limitation, any online casino, sports books, bingo or poker, and 3) other illegal activity and/or illegal contests.
• The application does not commit or facilitate the commission of a crime, or other tortuous, unlawful, or illegal act.
• The application does not contain any illegal content and complies with all applicable laws including:
  • Digital Millennium Copyright Act - http://www.copyright.gov/legislation/dmca.pdf
  • Video Privacy Protection Act

Section 2: Content Appropriateness

• The application does not advertise or promote the usage of ammunition and/or firearms, tobacco products and/or other drugs, liquor, beer, wine and other alcoholic beverages.
• The application does not contain any depictions of animal abuse, sexual abuse, drug abuse, alcohol abuse, child abuse, or domestic abuse.
• The application does not contain content that is pornographic or obscene, contains full nudity, or is strongly sexual (explicit depictions of sexual behavior).
• The application does not contain intense violence such as graphic or realistic-looking depictions of gore, human injury, or death. This includes sexual violence and any depictions of rape or other violent sexual acts.
• The application does not contain content that is hateful or threatening, whether directed at an individual or a group, and whether based upon the race, sex, creed, national origin, religious affiliation, marital status, sexual orientation, gender identity, or language of such individual or group.
• The application does not contain content that is defamatory, libelous, or slanderous.
• The application does not promote any organizations associated with hate, criminal, and/or terrorist activities.
• The application does not promote the harassment, intimidation, or bullying of another user.
• The application does not contain content that is widely considered to be highly offensive.

Section 3: Data Collection

• The application does not perform any action that has the intent of deceiving the user into entering personal or financial information.
• The application does not collect users’ information without the user’s express permission and notification. This includes robots, scrapers, spiders and harvesting bots.
• If the application does collect user information, it will be made clear that it is being collected by you, not Palm or any of Palm’s operator partners. Also, the application must reference and provide direct access to a publicly-available privacy policy explaining what information is being collected and how that information will be used.
• The application does not attempt unauthorized access to data, resources, or accounts of any person.

Section 4: Other

• The application provides value to the user.
• The application does not include spam (disruptive commercial messages or advertisements).
• The application does not interfere with, disrupt, damage or access in an unauthorized manner the servers, networks, or other properties or services of Palm or any third party including, but not limited to, any mobile communications carrier.
• The application does not encourage users to spam other users knowingly or unknowingly.

Technical Criteria

I certify that the following statements are true about the application being submitted:

• The time to launch has been tested multiple times and on average launches within 4 seconds. If the application takes more than 4 seconds to launch, it displays an animation to indicate that the application is starting, and provides any cached content from previous usage, if available.
• The shut down time has been tested multiple times and is on average less than 3 seconds.
• The application has been designed to minimize memory, CPU usage, and network bandwidth and has been extensively tested on a physical device to verify that it does not adversely affect performance or battery life.
• The application has been tested to run on the minimum OS version specified.
• The application does not use undocumented webOS APIs or other capabilities outside the scope of the public Mojo SDK.
• The application does not use the APIs in a manner that exceeds reasonable request volume, constitutes excessive or abusive usage, or otherwise fails to comply or is inconsistent with any part of the API documentation as determined by Palm.
• The application has no known crashing bugs and does not lose user data.
• If applicable, the application uses native applications in the correct manner (e.g. tapping content such as a phone number should launch the phone dialer).

User Interface Criteria

• I have read and have taken reasonable efforts to abide by the recommended User Interface Guidelines.
