I've decided to remove this thread and continue to focus on email correspondence with Palm.

actually, we have answered them, but it's an answer they don't like, and now they're asking us to get into things that by policy we don't discuss, in this case, specifically "why this one and not mine?" type rejections. and they don't like that we aren't getting into that discussion.

So it's not a matter of no replies, it's a matter of the answer they got not being the one they wanted and when they tried to get us into a discussion we declined to get into, not liking that.

...which only seems to reference nudity/pornography/sexual behaviour; none of which is featured in my app.


Since this is all being aired in public for some reason, please at least describe what your app does?

(and if I sound vaguely annoyed right now, well, you do not want to know how many hours I've spent dealing with Jiggly Boobies and discussing this with other members of the team.... Although I do have to admit it's kinda fun to set up meetings where the agenda is...

oh, well, you get the point. Discussions around webOS App Review world headquarters are not always HR friendly)

No, not helping, sorry.

The name in of itself is highly suggestive, and the word "boobies" alone does cross over the line. While it does not show nudity, it is pornographic in the "jiggling" part.

If you want to argue that the "girls" apps should not violate this, consider the fact they do not have animations that make a specific 'anatomical region bounce around'.

I see Palm's point in this regard, it simply crosses the line (albeit by only a foot or two, but still crosses it).

Yes, boobies is crossing the line. Where is the artistic merit in this app that would help 'unclassify' it as pornographic?

The focus on the singular anatomical region is the primary concern here. If the whole image bounced, I could see your point. But the focus is what crosses the line.

Every instance I can think with "jiggling boobies" (a phrase I never thought I would type on the Palm development board) is either a sex act taking place or portraying women in a sexual nature. I would say it is easy to see how this could be "strongly sexual" as described in the agreement section from Palm that you quoted.

Palm does give you other avenues to distribute your app.

No way does this cross the line... Maybe the title is a bit suggestive. Great music on the youtube video...

Surprised apps like tipandstrip.me, hooters calendar and pin-up hunt are ok but this isn't?

Maybe just change the name to jiggly wiggly or something.

Here is the quote from the app catalog submission guidelines:

Here is the definition of "pornography" from dictionary.com:

Here is the definition of "obscene" from dictionary.com:

While it's subjective, I think your app could fit under these definitions of "pornography" and "obscene". I would imagine this is the reason why your app was rejected. Ultimately, it's Palm's decision of what they consider to be pornographic or obscene. Based upon the current selection of girl picture apps in the catalog, I would say the "line" would be that static pictures are ok. Animated pictures are not. Again, this is just my interpretation of their guidelines based upon your app's rejection and other apps allowed in the catalog.

This is an excellent point. For Palm to enforce this with you, there is no doubt they'd also need to remove the other apps. (as well as the web browser, picture viewer and video player from the device)

Personally, I believe it is harmless fun. Subjective, and there will be plenty on both sides.

However, I also believe in following the guidelines set forth by Palm, and based on those guidelines, this app crosses the line into pornography. Again, it only crosses a foot or two over the line, but over the line none-the-less. That is the real argument here, our personal feelings are besides the point.
